Frequently asked questions about civil law
What contract do you recommend for selling real estate?
A purchase agreement with notarised signatures is essential. We also recommend an escrow agreement for the purchase price held by a lawyer, which protects both parties.
Can I challenge a will after the testator's death?
Yes. A will can be challenged in probate proceedings or by separate action. Grounds include formal defects, incapacity, mistake, deceit, or duress.
What is the limitation period for a damages claim?
The subjective limitation period is 3 years from when you learned of the damage and who caused it. The objective period is 10 years from the occurrence of the damage.
What is adhesion (joinder) and when should I use it?
Adhesion proceedings allow you to claim damages directly within criminal proceedings if you are a crime victim. It is faster and more cost-effective than a separate civil action.
Do you assist with out-of-court dispute resolution?
Yes. We always seek an out-of-court resolution first — negotiation, mediation, conciliation. Litigation is the last resort.
