Frequently asked questions about criminal law
When is a defence lawyer mandatory in criminal proceedings?
Mandatory defence applies in cases of custody, juvenile defendants, diminished capacity, or where the offence carries a sentence of more than five years. However, we recommend retaining a lawyer even when not required by law.
Can I choose my own ex officio defence lawyer?
Yes. You may designate a specific lawyer even in mandatory defence cases. Simply name your preferred lawyer at your first contact with the police or court.
How long do criminal proceedings take?
Duration depends on case complexity. Simple matters may conclude within months; complex white-collar cases with international elements can take several years.
Can victims receive free legal representation?
If you meet the conditions for free legal aid under Act No. 45/2013 Coll. on victims of crime, you may be entitled to free representation. We assess eligibility at the initial consultation.
What is adhesion (joinder of civil claim)?
Adhesion proceedings allow the victim to claim damages directly within the criminal trial — without needing a separate civil lawsuit. If the court convicts the defendant, it may simultaneously order compensation.
What should I do if I have been defrauded?
Immediately contact your bank, preserve all evidence (screenshots, emails, bank statements), file a criminal complaint (ideally drafted by a lawyer), and seek legal advice — not a dubious 'recovery firm'.
Do you handle cases with an international element?
Yes. We communicate in Czech and English and have experience with cross-border criminal cases, utilising EU mutual legal assistance (MLA), Interpol, and Europol.
